Under Utah law, a child is defines as a person under the age of 14 years. Hence, the legislature, and rightly so, has enacted laws that protect children against these types of crimes. They range from touching, over or under the clothing, rape of a child, sodomy on a child, etc. These crimes are often crimes of opportunity and are perpetrated by family members, friends, etc., who have access to children.
Charges of this nature can also be brought based upon statements made by alleged victims that are prompted by a parent seeking to gain the upper hand in a custody dispute or simply to be vindictive toward a family member. Others, unfortunately are true. It takes experience to tell the difference and present the case accordingly, asserting that rehabilitation is preferable to retribution.
It is also helpful in some cases to have the child’s interview reviewed by a psychologist and perhaps even having the victim interviewed.
